A Defendant's Long Road Through The Federal Justice System
Thu, 20 Jun 2013 09:19:00 -0400 - For white-collar criminal defendants, it takes a long time for their cases to make their way through the federal justice system.  These crimes, alleged crimes, are not like those of a person holding up the corner liquor store where the perpetrator is discovered, cuffed and thrown in the pokey within a one week period.  White-collar defendants are usually investigated for years, arrested and then start the road to the federal courthouse to defend the case .... usually pleading guilty at some point along the way.  The federal system takes its sweet time and even those who have pleaded guilty, wanting to get the prison term started at Club Fed, may have to wait a while.
Assessing The Teams' Performances Six Games Into The CONCACAF Hex
Thu, 20 Jun 2013 09:09:00 -0400 - In late-January this blog outlined some high-level metrics to watch as the Hex progressed.  Achieving the following would give a team a good chance of making it to Brazil in 2014: Overall PPM should be at or above 1.6 (16 points overall). Home PPM should be at or above 2.2 (11 points total at home). Away PPM should be at or above 1.2 (6 points total away). Goal differential should be equal to a half a goal per match (+5 GD overall). The key takeaway was that only one team had earned sixteen or more points and not automatically qualified for the World Cup (the 2009 Costa Rica side).  So how have each of the teams performed against each of these metrics across the first six matches?  The table below summarizes the teams’ current performances against all four metrics, as well as likelihoods for finishing with seventeen points with their current goal differential pace as well as what each team’s overall PPM means for likely finish position with the table.

The United States Is Still Pretty Popular In Russia
Thu, 20 Jun 2013 09:00:00 -0400 - While Russian state-owned media does traffic in more than its fair share of anti-American and anti-Western conspiracy theories, you don't need to look very far to find Russian TV spouting some pretty strange ideas on, well, almost anything,  I've always thought that this has been over-hyped as a way of understanding the Kremlin's decision making. For the Russian government anti-Americanism isn't a replacement for Marxism Leninism, an ideological framework that guides all decision making and through which all developments must to be measured. It's, instead, a tactic of convenience that is sometimes chosen and sometimes eschewed depending entirely on the nature of the topic being discussed.

Dollar Dictates In Bernanke's Twilight Zone
Thu, 20 Jun 2013 08:54:00 -0400 - As expected, Chairman Ben Bernanke and his buddies at the U.S. Federal Reserve were hawkish, but being aggressively so against expectations has reopened many of this month's asset class price wounds. Yesterday, the Fed managed to tick the message transparency box. In its communiqué and press conference, the Federal Open Market Committee (FOMC) delivered its 'tapering' stance message loud and clear – it's on the table. The Fed is not poised to raise rates anytime soon, but assuming key data keeps improving, it will look to trim its monthly $85 billion bond purchase later this year. That precise message succeeded in pushing U.S. Treasury yields to reach 15-month highs, in-turn allowing the mighty buck to rule the roost once again.

Black Blood Of The Earth: A Unique Coffee Experience From An Unusual Entrepreneur
Thu, 20 Jun 2013 08:50:00 -0400 - The products that stumble forth from Philip Broughton’s restless, inventive brain are more the result of his own curiosity and sense of fun than they are a deep desire to build a business. His company, Funranium Labs, is more a playground and message board for he and fans of his two products: an intense concentrated coffee brew called Black Blood of the Earth, and a beer stein called Stein of Science that keeps liquids cold for hours. Broughton, who works as a radiation safety specialist at UC Berkeley and an adjunct professor at Las Positas College in Livermore, CA., generated $150,000 last year with his one-man side company at 20% profit margins, taking online orders and shipping out product. About $100,000 of that came from his coffee. No-Nonsense Coffee His flagship product, Black Blood of the Earth, is a concentrated coffee drink made by the cold water extraction of the oils and essence of ground coffee beans, sans acidity. What’s produced is a strong, flavorful brew with less bitterness and between 20 and 40 times the caffeine of regular coffee. Due to its extreme potency, the Black Blood should be consumed in small quantities—a caution I observed when I tried some of Broughton’s Kona blend. The origins of Black Blood of the Earth lie in Broughton being diagnosed a diabetic in 2009. Partial to highly sugared coffee from local cafes near UC Berkley, he decided to figure out how he could have a jolting coffee experience without having to mitigate the bitter taste with sweetener.   Taking inspiration from photos of a Vietnamese triple-extraction apparatus, Broughton built his own cold-extractor and began experimenting with his own coffee brews. Broughton has shipped his Black Blood all over the place to those who appreciate a more intense coffee experience, sending bottles of the brew to customers domestically as well as overseas. “I find that a lot of my coffee is going into the hands of IT and research,” Broughton says. “And writers.”
Ben Bernanke's Lead Foot Drives Markets Down
Thu, 20 Jun 2013 08:34:00 -0400 - Ben Bernanke tried to break the news as delicately as he could yesterday when he indicated that the Federal Reserve may soon reduce the central bank’s massive bond buying effort and put a stop to it entirely within a year. He said nothing was set in stone and wanted to “emphasize” that nothing had been “predetermined,” adding that any new moves would depend on incoming data and economic projections.
A.M. Kitco Metals Roundup: Gold, Silver Hammered to 2.5-Year Lows; Major, New Chart Damage Suggests More Downside To Come
Thu, 20 Jun 2013 08:33:00 -0400 - (Kitco News) - Gold and silver futures prices are sharply lower and have careened to better-than-2.5-year lows in early U.S. trading Thursday. The market place sees traders and investors in a keen “risk-off” mentality following Wednesday’s U.S. Federal Reserve events. Fresh, serious technical damage has been inflicted in the gold and silver markets to suggest they will see still more downside price pressure to come. Comex August gold last traded down $70.10 at $1,303.90 an ounce. The August contract traded down to a low of $1,285.00 in overnight trading. Spot gold was last quoted down $46.40 at $1,305.25. July Comex silver last traded down $1.458 at $20.165 an ounce. July silver hit a low of $19.64 in overnight trading.

Five Rules For General Counsel In The Digital Age: Risks Abound, But So Do Opportunities
Thu, 20 Jun 2013 08:31:00 -0400 - When most corporate general counsels look at that the world of digital and social media, they see a landscape rife with risk. The potential for an ill-advised employee tweet or Facebook post is always lurking. Online venues have provided plaintiffs’ attorneys and activists with megaphones that amplify their messages. When crisis strikes, the speed with which the public narrative develops and is disseminated is nearly impossible for all but the most prescient companies to match.
